Rodd & Gunn Entry Terms & Conditions
- Information on how to enter and prize details form part of the conditions of entry.
- The competition commences at 5PM NZST on Monday 24 August 2020 and ends at 11:59PM NZST on Saturday 5 September 2020 (the Promotion Period).
- Any eligible person residing in New Zealand who is over 18 years who follows the Rodd & Gunn Instagram or Facebook page and the Kauri Bay Boomrock Instagram or Facebook page and the Lodge Bar Instagram or Facebook page AND comments on (including tagging 4 friends in the comments) and likes any of the relevant competition posts (posted during the Promotion Period) is eligible for the competition.
- Rodd & Gunn (as the promoter) will determine (in its absolute discretion) a total of one (1) winners winning entries which fulfils the requirement of the competition. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon individual creative merit. All entries must be an independent creation by the entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions.
- When contributing material to the competition you must not include offensive, unlawful, obscene, defamatory, indecent or inappropriate content in any form. Rodd & Gunn, as the promoter, reserves the right (in its absolute discretion) to: delete any content on the Rodd & Gunn Instagram page that (in Rodd & Gunn’s opinion) offends this term; and disqualify your entry to the competition.
- All employees of the promoter or its related bodies corporate and the immediate families of such employees are ineligible to enter.
- One (1) winner will be announced on the Rodd & Gunn Instagram by 2PM NZST on Monday 7 September 2020. If the prize winner does not respond within 72 hours of initial contact, the promoter reserves the right to award the prize to a secondary winner and the winner will forfeit their prize. If the secondary winner does not respond within 72 hours of their initial contact, the secondary winner will forfeit their prize and the promoter reserves the right to cancel that portion of the promotion.
The total prize pool is valued at $7,250.00 (NZD). The prize consists of:
- One (1) Kauri Bay Boomrock experience (to be designed by Kauri Bay Boomrock) valued at $6,000.00 (NZD) total.
- One (1) The Lodge Bar Dining, Commercial Bay, Auckland voucher valued at $500.00 (NZD) total.
- Five (5) Rodd & Gunn vouchers valued at $150.00 (NZD) each ($750.00 (NZD) total).
- The prizes do not include any other expenses incurred while using the prizes or entering the competition.
- Rodd & Gunn is not responsible for any actions taken by Instagram when posting or commenting.
- Each Prize is non-transferable and cannot be exchanged or taken as cash.
- The promoter’s decision is final and binding, and no correspondence will be entered into.
- The promoter is Rodd & Gunn Australia Pty. Ltd. (ABN 11 003 714 458) trading as Rodd & Gunn, Level 1, 540 Malvern Road, Prahran, VIC 3181.
- By entering and participating, the entrant agrees to hold harmless, defend and indemnify Instagram from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of or related to (i) entrant’s participation in the game of skill, or (ii) entrant’s participation in any Prize related activities, acceptance of a Prize and/or use or misuse of a Prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s).
- This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram.
- No responsibility is accepted for lost, delayed or misdirected mail.
- Except for any liability that cannot be excluded by law, the promoter and its related bodies corporate (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the promoter) due to any reason beyond the reasonable control of the promoter; (d) any variation in prize value to that stated in these Terms and Conditions;(e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
- The personal information submitted in an entry is collected by the promoter and will be used for the purpose of conducting the promotion. Personal information supplied by entrants may be provided to related bodies corporate or agencies of the Promoter and third parties involved in promoting or conducting the promotion for the purposes of conducting the promotion and future marketing and publicity communications. Name and contact details of entrants may be used as a mailing list for future promotions and marketing carried out by the promoter, including via electronic messages and telephoning the entrant. - If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the promoter, the promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
